Fatal Road Traffic Accident Inquest

When there has been a fatal road traffic accident, the coroner will establish an inquest to ascertain the cause of the accident and the factors that led up to it. The outcome of the inquest will seek to identify if there was negligence on the part of anyone.

 

Depending on the outcome, if it is determined that a party or parties were to blame for the accident, the next of kin and anyone else who has suffered as a consequence of the accident can instruct a solicitor to begin proceedings to recover compensation.

Am I and other dependents entitled to compensation for the loss of a loved one? 

You have a right to compensation if you are surviving dependent and the fatality was as a consequence of someone else being wholly or partially negligent. Surviving dependents include spouses, civil partners, parents and children of fatalities who were under 18 years.

 

Compensation is assessed on the basis of the pain or distress suffered by the deceased before their death, financial losses due to the fatal accident, medical expenses, loss of earnings and funeral expenses.
