Lourdes Hospital Redress Scheme - 12 August 2007 deadline for applications

Women who had wrongful procedures carried out by a consultant obstetrician in Drogheda have 47 days to apply for compensation.

A deadline of 12 August 2007 has been set for applications to The Lourdes Hospital Redress Scheme. The scheme was established to compensate victims of the wrongful practices of Dr Michael Neary, a former consultant obstetrician at Our Lady of Lourdes Hospital in Drogheda, Co Louth. Dr Neary was found to have carried out unnecessary hysterectomies and oopherectomies (removal of ovaries) during the period 1974 to 1998.

Under the terms of the scheme, the following women, who had operations carried out by Dr Neary, are entitled to apply for compensation:

  • Those who had an unplanned obstetric hysterectomy which in the opinion of a consultant obstetrician was medically unwarranted
  • Those who had an unplanned bilateral oopherectomy (removal of both ovaries), in association with an obstetric hysterectomy, which in the opinion of a consultant obstetrician was medically unwarranted
  • Those who had their remaining single functioning ovary removed, in association with an obstetric hysterectomy, which in the opinion of a consultant obstetrician was medically unwarranted
  • Those who had an unplanned obstetric hysterectomy where the woman's relevant medical records are unobtainable
  • In association with a recent pregnancy, a D&C (dilation and curettage) or ERPC (evacuation of retained products of conception) or EUA (examination under anaesthetic) which was followed by an unplanned hysterectomy where such hysterectomy was in the opinion of a consultant obstetrician to be medically unwarranted.

An obstetric hysterectomy means a hysterectomy that was carried out in association with a pregnancy that was either in peripartum (around birth) period or following from a miscarriage or incomplete abortion.

The deadline of 12 August 2007 is 60 days from the commencement of the scheme. Any application that is made after 12 August 2007 will not be considered unless exceptional circumstances exist such that the board is of the opinion that the interests of justice deem it necessary to receive the application.

Dr Neary was struck off the medical register following a report that was written by Judge Maureen Harding Clarke into the obstetrician's practices at Our Lady of Lourdes Hospital in Drogheda, Co Louth.
