Dr Neary - excluded victims seek damages

A group of women who were damaged as a result of the practices of Dr Michael Neary are to seek compensation through the State Claims Agency.

The women were excluded from the Lourdes Hospital Redress Scheme which was set up to compensate victims of the unlawful practices of Dr Neary. The obstetrician was found to have conducted unwarranted hysterectomies and oopherectomies (removal of ovaries) whilst working at Our Lady of Lourdes Hospital, Drogheda, Co Louth between 1974 and 1998.

The Lourdes Hospital Redress Scheme excluded a number of victims including women who were over 40 when they were operated on by Dr Neary and women whose babies died as a result of Dr Neary's practices. Many such persons have instituted proceedings against various defendants including the State. These actions will be subject to a technical defence that they were time barred as legislation requires proceedings to be instituted within 2 years of date of knowledge of the adverse event.

The deadline for applications to the Lourdes Hospital Redress Scheme was 12 August 2007, although in certain exceptional circumstances, applications may be accepted until Tuesday, 11 September, 2007. This is at the discretion of the Board and applications will not be considered by the Board after 11 September.
