DePuy Hip Replacement Recall

Patients who received defective hip replacements are currently being advised as to whether or not they will need a revision surgery in the coming months.

All patients who were fitted with either of the defective products in question - DePuy Orthopaedics' ASR Total Hip Replacement or the ASR Hip Resurfacing System - will be informed by their consultant orthopaedic surgeons as to whether their implant requires to be removed or replaced.

This decision is based on the results of various medical tests, i.e., blood tests to determine the level of cobalt and/or chromium metal ion particles in the bloodstream; x-rays; MRI scans; ultrasound scans.


Malcomson Law have been contacted by many people affected by the recall who find themselves at various stages of this medical process. Accordingly, Malcomson Law are advising those affected to attend their hospital appointments to ascertain the extent of any potential difficulties that may occur.


In the event that revision surgery is deemed necessary, a hugely important aspect of any litigation will be the possession of the removed or excised implant - therefore Malcomson Law are utilising the law of Bailment on behalf of clients facing a revision surgery, so that the removed/excised implant will be kept secure to the benefit of the patient/client.


Patients must also be aware that each subsequent revision may have a lesser 'lifespan'. In younger patients especially, this may lead to further surgical intervention and medical issues, and therefore further losses. While DePuy have offered to pay for the reasonable medical costs associated with the recall, Malcomson Law are advising clients that the true costs will inevitably run much higher, and for a longer time-period than envisaged or accepted by DePuy.
