Alternative Dispute Resolution Options

There are a number of options available to our clients for dispute resolution, without going to court, including:

  1. Negotiation
  2. Mediation
  3. Expert Determination
  4. Arbitration

1. Negotiation

Negotiation is a method of solving disputes in a non-contentious manner. If a business relationship has deteriorated to the extent that a dispute arises, opening a channel of communication through Malcomson Law can prove successful in terms of resolving this dispute. Alternatively, if it becomes apparent to us that a Commercial Court Action should be necessary, we will advise our clients of this necessity. Such proactive attention can be of significant benefit in terms of the overall conclusion to the litigation process.


2. Mediation

Mediation is becoming increasingly popular as a means of resolving disputes. The Commercial Court, which came into existence in 2004, provides for mediation. Malcomson Law recognise the benefits for clients in resolving disputes as speedily as possible. We advise and represent our clients prior to, during and after the mediation process.


3. Expert Determination

Through our association with US Law Firms, Malcomson Law have embraced the concept of using Experts to solve the complex issues that have resulted in disputes. The process involves both parties agreeing to allow an independent Expert to form an opinion of how the dispute should be handled and/or resolved. At Malcomson Law, we have found Expert Determination to be extremely successful in disputes that are of a complex and/or scientific nature.


4. Arbitration

Malcomson Law has been to the fore in resolving many disputes. We have experience in a range of areas, including product liability, property, and contractual disputes.

We have particular expertise in construction disputes that result in arbitration hearings. Our solicitors are qualified arbitrators with a myriad of experience, both in Ireland and the United Kingdom.
