Compulsory Purchase Orders

Print this page

What is a Compulsory Purchase Order?

A Compulsory Purchase Order (CPO) is a notice that is received by a landowner. It refers to the compulsory purchase of land to allow a public infrastructure project to be completed for the public budget e.g. lands acquired by NRA for construction of public roads. CPO's are normally made in order that road improvement schemes can occur or public transport systems can be created or upgraded, e.g., construction of a LUAS line.

The Compulsory Purchase system is an extremely complex area. Malcomson Law has specialist knowledge and in excess of 20 years experience in dealing with Compulsory Purchase Orders (CPO) in both the private sector and at local Government level.

What can I do if I am served with a CPO?

If you are served with a Compulsory Purchase Order you have the right to object, make representations, negotiate, refer to property arbitrators and have your objections heard.

Compensation

If your house and/or land are the subject of a Compulsory Purchase Order, you will be eligible for compensation. This compensation should leave you in the same position as you were in before your property and/or land was acquired. Your compensation should be paid based on the market value of your property/land. ]
